I. GoDrive General Terms and Conditions
These General Terms and Conditions of Car Rental (hereinafter referred to as the “GTC”) are an integral part of the rental agreement (hereinafter referred to as the “NS”), which is concluded automatically with each vehicle reservation in the GoDrive mobile application pursuant to § 2321 et seq. Act No. 89/2012 Coll., Civil Code (hereinafter "Trademark"), between the company DriveSmart sro, with its registered office in Prague 8, V mezihoří 2448/4, ZIP code 180 00, IČ: 064 265 57, DIČ: CZ06426557 (hereinafter referred to as the “lessor”) and the lessee listed in the NS (hereinafter referred to as the “lessee”). Based on the NS, the lessee leases the vehicle specified in the NS for temporary use. Before concluding the contract, the renter is obliged to explicitly confirm his/her consent to these GTC by ticking the appropriate box in the mobile application.
1. Registration, reservation and NS
1.1. The reservation of the vehicle is made exclusively through the mobile application GoDrive CZ, and only after the previous completed registration of the lessee at the same place. The registration is only valid if the lessee has filled in the correct details. The Lessee is obliged to fill in a functional and true e-mail address and telephone number during registration and to keep them up to date (i.e. in case of a change, the Lessee is obliged to update the data in the mobile application without undue delay). The e-mail address and telephone number serve as the primary communication channels between the Lessee and the Lessor. Completed registration is conditioned by stating the identity of the tenant, including a scan of a valid ID card and driver's license, and at the same time by depositing a valid payment card such as Visa or MasterCard, through which the rental is paid after its termination. When adding a payment card, the amount of CZK 1 is deducted to verify the validity of the card, which is immediately returned. Payment card details are not processed in any way by the Lessor. The data is securely stored at the bank providing the payment gateway: ČSOB, as, IČ: 00001350. If the withdrawal of the amount of CZK 1 cannot be carried out, it is not possible to use the application functions, especially car reservations. If the entire registration is successfully completed, reservations can be made at any time. When booking, a calendar is used that displays the currently available cars for the selected period, including their location and approximate rental price. By pressing the book button, the car is reserved and the NS is automatically closed, which is valid for the entire reservation period. The price for the loan is listed in the price list on the website www.godrive.cz.
The lessor is entitled to require a refundable deposit of CZK 3,000 from each new lessee, which will be unilaterally charged to the lessee's credit card on the first ride. On the basis of an individual assessment of the riskiness of the tenant, the landlord is entitled to increase the deposit up to CZK 10,000.00, and the tenant will always be informed of this increase in advance. The security deposit shall be used to pay any claims of the lessor against the lessee arising from the lease agreement, including but not limited to rent, contractual penalties, damages and other financial obligations. In the event that the Lessee fails to pay the required security deposit, the Lessor shall not be obliged to allow the Lessee to drive.
The decision on the amount of the security deposit is entirely within the lessor's discretion, taking into account in particular the payment record and the history of use of the service by the lessee. If the lessee has a problem-free payment history, the security deposit is refundable after three months from the date of deposit. The security deposit shall be refundable within 15 days of receipt of the tenant's request for its return, by wire transfer to the tenant's bank account. The lessor is entitled to require the lessee to prove his identity and verify the ownership of the bank account to which the deposit is to be returned. The security deposit is not subject to interest.
The lessor is entitled to unilaterally set off its claims against the deposit, especially claims arising in connection with unpaid rent, fines or damages caused by the lessee. The unused part of the security deposit that has not been used to pay claims is refundable within 15 days of receipt of the tenant's request for its return, by wire transfer to the tenant's bank account. The lessor is entitled to require the lessee to prove his identity and verify the ownership of the bank account to which the security deposit is to be returned.
1.2. In the event that the Lessee reserves a vehicle with the lessor, but does not pick up the vehicle in accordance with the Reservation or NS, or cancels the reservation later than 60 minutes before the start of the reservation, he is obliged to pay the Lessor a contractual penalty of up to CZK 200 depending on the number of reserved hours. The minimum cancellation amount is therefore the current hourly rate for the loan. Cancellation more than one hour before the start of the reservation is free of charge.
A contractual penalty is an amount agreed by the parties in the event of a breach of a specific contractual obligation (hereinafter referred to as the "contractual penalty").
1.3. The Lessor provides insurance coverage for the vehicle to the extent and under the terms of the statutory insurance for liability for damage caused by the operation of the vehicle (so-called compulsory liability insurance). The proof of insurance is part of the vehicle equipment.
1.4. The Lessor also provides accident insurance for the vehicle up to the amount of the deductible.
1.5. The Lessee shall immediately notify the Lessor of any damage to the vehicle that occurs at any time during the booking period and pay the corresponding amount of the deductible. The amount of the deductible is 5% of the total damage, but not less than CZK 5,000. To this amount shall be added a lump sum compensation for the costs of damage to the vehicle ("lump sum compensation") up to a maximum of CZK 10,000. In the case of total damage, the deductible is increased to CZK 25,000.
In the event of an accident involving another road user, the Lessee is obliged to draw up an accident report with the other party, which is available in the vehicle. Failure to make a record may result in a contractual penalty of CZK 2,000 and a possible obligation on the part of the hirer to pay the difference between the full and the incomplete insurance benefit if the insurance company refuses to pay the full amount of the damage due to the lack of an accident record.
Lump sum compensation is a fixed amount charged to the Lessee over and above the Lessee's deductible and is intended to cover the costs associated with the administrative and operational handling of the claim. This compensation is applied up to CZK 10,000 and includes in particular:

administrative costs associated with the settlement of the claim, including communication with the insurance company and documentation,

costs of assessing the technical condition of the vehicle and quantifying the damage,

costs related to the reduction of the operability of the vehicle, including lost profits and any compensation to customers,
-
any other operating costs, such as towing charges or the cost of providing a replacement vehicle.
The application of the lump sum indemnity shall not affect the Lessee's obligation to pay the deductible in accordance with the terms of this Agreement.
1.6. The Lessee is obliged to reimburse the Lessor for any damage to the vehicle up to the amount of the Lessor's deductible on the insurance claim, if the insurance company provides such insurance claim. The amount of the Lessee's liability shall not be limited in cases where the insurance company does not provide the insurance benefit due to the fault of the Lessee (in particular in case of violation of these GTC) and/or if the damage is not covered by insurance.
1.7. In the event of a traffic accident, regardless of whether the Lessee is at fault or not, the Lessee is obliged to immediately inform the Customer Service Line +420 777 102 144 of the Lessor about the traffic accident and follow its instructions. In case of unavailability of the Customer Service Line, the Lessee is obliged to call the Assistance Line indicated on the Green Card. In the event of a traffic accident, the Lessee is also obliged to notify the Police of the Czech Republic, to follow their instructions and, if necessary, to draw up a joint record of the traffic accident with the other party involved in the accident and to forward it immediately to the Lessor. The accident report must contain identification of the place and time of the accident, the participants and vehicles involved, its cause, course and consequences, and other details required by law. In cases where the Lessee is obliged under the Road Traffic Act to report the accident to the Police of the Czech Republic.
1.8 In the event of any damage to the vehicle, the Lessee is obliged to report such damage to the Lessor via the Customer Support Line or e-mail and to follow the Lessor's instructions. The Hirer shall provide the Lessor and its insurance company with all assistance and cooperation necessary for the full investigation of the damage and its settlement, or for its legal proceedings, otherwise the Hirer shall be liable for any damage incurred by the Lessor as a result of a breach of this obligation. The Lessee shall also be obliged to pay the Lessor a fee for the handling of an insured event caused by him/her in the amount of a deductible of 5% of the total damage, but at least CZK 5,000, and a lump sum compensation of up to CZK 10,000, see section 1.5.
1.9.The Lessee is obliged to properly protect the vehicle key from any damage, destruction, loss or theft. The Lessee shall be liable for damage caused by mechanical damage, destruction, loss or theft of the key until it is properly returned with the vehicle, as well as for other related damages. In the event of damage, destruction, loss or theft of the vehicle key, the Lessee shall be obliged to compensate the Lessor for the damage resulting therefrom, in particular the production of a new key or related costs such as access to the vehicle, setting up the relevant systems, etc. In the event of destruction, loss or theft of the key, a contractual penalty of at least CZK 10,000 is agreed and the lessee is always obliged to pay this to the lessor; if the actual damage is higher, the lessor is entitled to demand payment of the contractual penalty up to the actual amount of the damage. The lessor is always entitled to unilaterally charge the lessee's credit card for the damages.
1.10. By making a reservation, the Lessee agrees to charge all fees and contractual penalties referred to in points 1.1. to 1.9. to the credit card provided in the reservation. He/she also agrees to maintain a sufficient balance in his/her account to be able to charge the full invoiced amount for the rental of the vehicle, including any deductible or other financial obligations arising from the rental agreement.
1.11. The Lessor is entitled to unilaterally charge the deposit to the Lessee's credit card, both at the beginning of the reservation and during the reservation. The amount of this deposit generally corresponds to the amount currently due. Furthermore, the Lessor is entitled to block an amount of up to CZK 5,000 on the Lessee's payment card, depending on the length of the reservation, in order to ensure payment of the fare and related fees. This block is cancelled after the booking is completed, or the amount actually spent is deducted from the blocked amount and the remaining amount is refunded. The duration of the unblocking of the funds depends on the hirer's credit card issuer, usually between 3 and 5 working days, the exact period of time can be checked with the hirer's credit card provider.
1.12. In the event that the Lessee reaches the pre-paid financial limit, i.e. fares in excess of the pre-paid package or in excess of the one-off deposit, the fare will be automatically recharged when the amount of at least CZK 300 is reached, and this amount will be automatically charged to the Lessee's payment card.
If the requested amount cannot be charged to the renter's credit card, the lessee will be informed by e-mail or SMS. In the event of insufficient funds on the payment card, the lessor is entitled to prevent the lessee from further travel until the amount due has been paid.
If the Lessee does not have sufficient funds on his/her credit card to pay the fare at the time the reservation is terminated, the Lessee agrees that the Lessor will attempt to re-collect the amount due. During this period, the Lessee shall have the option of paying the amount due by topping up the credit card or by transferring the amount to the Lessor's account, which may be requested by email or telephone. If the amount due cannot be charged to the credit card, the lessor will send the lessee a reminder stating the exact amount due, including any associated fees, the bank account for payment and the due date. If the Lessee fails to pay the amount due by the stated deadline and does not respond to the reminder, the Lessor shall be entitled to send the Lessee a pre-suit demand for payment of the debt and subsequently proceed with the filing of a lawsuit and the recovery of the amount due through the courts or other means of recovery.
For each day that payment is in default, the Lessee agrees to pay a contractual penalty of 0.1% of the amount due per day, which will be added to the amount to be charged. The total rent is due at the time of termination of the booking. At any time during this period, the Lessee has the option to pay the amount due by topping up his/her credit card and/or by transferring it to the Lessor's account, which can be requested by email or telephone.
1.13. The NS is concluded for a fixed period of time, at the time of booking, when the exact date and time of the start and end of the booking must be filled in. In the event that the booking time is longer than 60 minutes, the Lessee will be charged for the last hour of the booking according to its actual use, in such a way that only the minutes used in the last hour will be counted. At the end of the NS, the Lessee is obliged to park the vehicle in one of the zones. Until the end of the reservation, the Renter is liable for any damage to the vehicle to the extent of the deductible.
1.14. The agreed rental period can be extended via the GoDrive CZ mobile application up to a maximum of 30 minutes before the next reservation for the vehicle. If the reservation is not extended, the lessee's return of the vehicle later than the time agreed in the reservation is considered a material breach of the reservation. In the event of delay by the Lessee in returning the vehicle to the Lessor, the Lessee shall be obliged to pay the Lessor the rental fee based on the hourly rate specified for the specific vehicle until the date of the return of the vehicle to the Lessor, and shall also be obliged to pay the Lessor a contractual penalty of at least CZK 10,000 for breach of this obligation.
1.15. The Lessee loses the right to limit his liability under the agreed terms and conditions and scope of insurance (deductible) on the date on which he should have returned the vehicle to the Lessor according to the reservation. In the event of loss, destruction or theft of the vehicle, the Lessee shall be obliged to pay the rental fee based on the hourly rate specified for the specific vehicle, including all other charges, until the date of reporting the loss, destruction or theft of the vehicle to the Lessor, or until the date of receipt of a Police resolution stating that the subject of the lease has been stolen or that the property has been abandoned on the grounds that criminal proceedings cannot be brought against a specific person.
2. Takeover of the vehicle
Collection of the vehicle takes place without the lessor's presence and is possible at any time during the booking period and also 5 minutes before the start of the booking. The vehicle is always parked in a specific zone, which is already known at the time of booking, and the exact location of the vehicle is known to the Lessee at least 30 minutes before the start of the booking.
Unlocking and locking of the rented vehicle is possible via the GoDrive CZ mobile app by pressing the Unlock/Lock button - it is therefore necessary that the lessee has the app available on their smartphone, which should be sufficiently charged. The Lessor is obliged to hand over the vehicle to the Lessee in good technical condition, with all documents, if required for its operation, at the time and zone specified in the reservation.
The vehicles are non-smoking, smoke pollution is charged with a contractual penalty of CZK 5,000, which corresponds to a comprehensive steam cleaning of the car interior. All possible damages (defects, shortcomings, scratches, etc.) of the vehicle, or any other comments, must be submitted by the lessee no later than when taking delivery of the vehicle via the GoDrive CZ mobile application and/or by calling the customer service line listed in the mobile application. The Lessee is obliged to confirm receipt of the vehicle by first pressing the Unlock button on the GoDrive CZ mobile app at the time of booking or 5 minutes before the start of the booking and, if the app prompts the Lessee to check the vehicle for damage, to perform this check as well. Any damage to the vehicle not indicated in the GoDrive CZ app is the responsibility of the Lessee. The Lessor shall be entitled to claim damages for any such damage to the vehicle with a specified deductible.
3. Rents and fees
3.1. The Lessee undertakes to pay the rent and all other fees associated with the use of the vehicle, including compensation for any damage, properly and on time. In the case of a rental for a period longer than 1 week, specific rental price conditions may be agreed. The total rental fee is payable at the time of booking termination.
3.2. Once the reservation is terminated, the amount corresponding to the total rental fee will be automatically charged to the Lessee's credit card. If the charge is unsuccessful, the Lessee will be informed by e-mail or SMS.
In the event of insufficient funds on the credit card, the landlord is entitled to temporarily block further use of the services until the amount due is paid in full. The Lessee is obliged to pay the amount due immediately, either by topping up the credit card or by transferring it to the Lessor's bank account, which can be requested by e-mail or by telephone.
If the amount owed is not collected, the lessor sends a reminder to the lessee containing: the exact amount owed including any related fees, payment details including the bank account for payment and the due date of the amount owed.
In the event that the lessee fails to pay the amount due within the stated deadline and does not respond to the reminder, the lessor is entitled to send the lessee a pre-action demand for payment of the debt. If payment is not made even then, the lessor may initiate legal proceedings to recover the amount due or use other legal means of recovery.
A contractual penalty of 0.1% of the amount due per day is agreed for each day of delay in payment of the amount due. The lessor is entitled to make repeated attempts to charge the amount due to the lessee's credit card.
Other actions shall be governed by the provisions of the New Civil Code.
3.3. The rental amount includes the vehicle rental fee, estimated administrative costs, theft or damage to the vehicle and fuel costs. The rental fee does not include the deductible and flat-rate compensation that may be added to it in the event of damage or theft of the vehicle. The rental fee itself is calculated as an hourly rate for the rental of the vehicle plus mileage, or a fixed rate if the user chooses one of the advantageous packages, the fuel consumed is included.
3.4. By accepting the NS, the Lessee agrees to charge the rental fee including the cost of insurance coverage, compensation for any damage to the vehicle, deductibles for damage to the vehicle, flat-rate compensation or any other fees associated with the rental of the vehicle, its towing, fines and parking to the payment/credit card specified in the user's registration, without prior notice. In the event of a "Challenge" to the vehicle operator for an alleged offence committed by the Lessee, the operator shall notify the relevant authority of the identity of the driver who was in possession of the subject vehicle at the time the alleged offence was recorded (such recording may also be after the termination of the lease, for example, when the vehicle was parked outside the rules of the road), or charge the required amount including the processing fee to the payment/credit card shown on the user's registration and subsequently prove the amount stated in the Challenge by forwarding the original Challenge to the Lessee's email address. The amount of the processing fee will be evidenced by an appropriate invoice. An additional invoice to the original Booking will be issued to the Lessee for this payment.
4. Conditions of use of the vehicle
4.1. The vehicle may only be used and driven by the person named in the registration. If another person is to drive the vehicle, a new registration and reservation must be made directly in the name of the person who will use and drive the vehicle. The Lessee shall use the vehicle solely for the purpose of using it in road traffic, for personal use and shall comply with all traffic, customs and other legislation and all instructions in the vehicle manufacturer's manual.
4.2. As the ability to unlock or lock the vehicle is directly dependent on the signal of mobile network operators, it is not permitted to park the vehicle in places where there is no such signal (atomic shelters, underground garages, shaded areas, etc.). If such a situation arises, the Lessee is obliged to immediately contact the GoDrive Customer Service Line +420 777 102 144, and acknowledges that a minimum penalty of CZK 3,000 will be charged for the trip leading to the car being put into operation.
4.3. The Lessee shall take care to prevent damage to the Vehicle and shall comply with all instructions on the operation of the Vehicle contained in the Vehicle manufacturer's manual as well as the conditions and instructions of the Lessor, otherwise the Lessee shall be liable for any damage caused by failure to comply with any instruction, condition or instruction. The Lessee shall secure the vehicle against theft, misuse or damage, in particular by locking it via the mobile app. The Lessee shall immediately inform the Lessor of the need for a regular service if this occurs during the booking period and is displayed on the vehicle's on-board computer.
4.4. The Lessee may not transfer the use of the vehicle to any person other than the person named in the registration, participate in races, competitions or similar events with the vehicle, use the vehicle to transport persons or property for payment, use the vehicle to push or tow cars or other objects, make any changes or modifications to the vehicle without the prior written consent of the Lessor, even at the Lessee's expense. In the event of a breach of this obligation, the Lessor shall be entitled to require the Lessee to remove the modifications and alterations without undue delay. If it is not possible to remove the modifications or changes, the lessee is obliged to compensate the lessor for the damage caused and the costs incurred by the lessor to restore the vehicle to its original condition. Furthermore, the Lessee is not entitled to use the vehicle for travel to countries outside Europe. In case of using the vehicle for travel to non-European countries, the lessee is obliged to pay the lessor a contractual penalty of CZK 20,000 for each individual violation.
4.5. The Lessee shall not drive the vehicle after having consumed alcohol, narcotics, drugs or other substances that may affect perception and reactivity, or let such a person drive the vehicle. The Lessee shall not use the car radio installed in the vehicle for listening to radio stations, the Lessee shall be entitled to use it only for listening to the sound recording from his own data carrier.
4.6. The lessor is entitled to request access to the vehicle in order to check whether the lessee is using it in a proper manner. The Lessee shall allow the Lessor to carry out such inspection.
4.7. Breach of any of the obligations listed in chapter 4 is considered a material breach of the NS and the lessee is liable for the vehicle and all damages caused in full regardless of the agreed amount of the insurance coverage deductible and at the same time the lessee is obliged to pay a contractual penalty of CZK 5,000.
4.8. If the Lessee uses the vehicle abroad, he/she is obliged to secure the relevant permits for the use of the vehicle abroad at his/her own expense and risk and to comply with the applicable legislation of the country in which the vehicle is used. The Lessee shall also be liable to the Lessor for damages resulting from any failure to comply with or breach of this obligation, and in the event that the vehicle is detained or impounded abroad, the Lessee shall take all necessary measures to release the vehicle and shall pay the agreed rent duly at all times. In this case, the rental period shall not end until the vehicle has been handed back to the lessor. The Lessee is obliged to pay for damages and costs incurred by the Lessor in connection with the detention or seizure of the vehicle, as well as towing and parking abroad and its return to the Czech Republic.
4.9. If any damage to the subject of the lease occurs, which is understood to mean in particular, but not exclusively, the destruction, loss or damage to the subject of the lease or its accessories, and if this is not covered by the agreed insurance cover, the lessee is obliged to compensate the lessor for this damage in full, unless it proves that the damage to the subject of the lease was caused by the lessor's actions. If the lessee fails to prove that the damage was caused by the lessor's actions, the lessee is liable for the damage objectively, i.e. regardless of the degree of fault. If the damage to the subject of the lease exceeds CZK 100,000, the lessee is obliged to pay the lessor a lump sum compensation for the reduction in the value of the vehicle in the amount of 20% of the repair price, in the case of destruction 20% of the wreck price.
4.10. The Lessee is obliged to refuel at the earliest possible moment, as soon as the refuelling indicator lights up. To do so, he/she shall use only the fuel card used to pay for the fuel, which is located in the passenger compartment of the vehicle. The fuel card is protected by a PIN code, the Hirer acknowledges that the PIN can be retrieved at any time during the booking process via the mobile app in the Booking section. A list of current petrol stations where the fuel card is accepted is available on the website www.ccs.cz. The Lessee is not authorised to pump fuel elsewhere than into the subject vehicle. Refuelling with a fuel card is only possible in the Czech and Slovak Republics; outside the Czech and Slovak Republics the Lessee is obliged to pay for the fuel from his/her own funds. This amount will be deducted from the total amount of the rental fee within 5 working days after the booking is completed and the receipt is sent by e-mail to podpora@godrive.cz. In the event of loss or theft of the fuel card, the renter is obliged to report this fact immediately to the GoDrive Customer Service Line +420 777 102 144. Until such time as the card is notified and blocked in accordance with the card issuer's rules, the Lessee shall be liable for all transactions made with the card and shall also be obliged to pay the Lessor a fee for arranging its blocking. A similar procedure will be followed if the Lessee fails to return the card together with the vehicle (i.e. blocking, fee and liability for all transactions until the fuel card is blocked).
4.11. The Lessee is obliged to maintain cleanliness, order and basic hygiene rules in the vehicle. The Lessee is obliged to use the vehicle in such a way that it is always returned to the Lessor with a clean interior free of any items that are not accessories or parts of the vehicle. To this end, the Lessee shall in particular refrain from any activities in the vehicle that result in soiling of the interior of the vehicle, including the windows, cause odours in the vehicle, or garbage is left in the vehicle, etc. In the case of transporting any animals, the Lessee is obliged to protect the interior from contamination as a precaution (in particular by covering the luggage compartment, transporting in a carrier, etc.). At the end of the journey, the hirer shall be obliged to clean the vehicle, for which purpose he/she shall be obliged to clean or have cleaned the vehicle if necessary. If the lessee fails to return the vehicle in a clean condition, the lessor is entitled to a contractual penalty of CZK 2,000. The lessor is always entitled to unilaterally charge the contractual penalty to the lessee's credit card.
5. Return the vehicle
5.1. The Lessee is obliged to return the vehicle with all accessories and documents, in particular the mandatory equipment, headlamps, to the Lessor at the time specified in the reservation, in the condition in which it was received, taking into account normal wear and tear. The vehicle cannot be returned or the reservation cannot be terminated if the vehicle is outside the zone. If the hirer soils the interior of the vehicle, he/she is obliged to clean it at his/her own expense. If the hirer soils the exterior of the vehicle only to the extent that the vehicle is still roadworthy (i.e. the front and rear registration plates are legible, the headlights are clean, the windows are clean, no dirt is falling or threatening to fall off the vehicle), the hirer is not obliged to wash the exterior of the vehicle. Should the vehicle be unfit for further use (heavy soiling of the exterior), he is obliged to clean it at his own expense.
5.2. If all accessories are not returned together with the vehicle, the lessor is entitled to demand from the lessee a monetary compensation corresponding to the price of the purchase of new accessories and at the same time a contractual penalty of CZK 1,000 for each individual violation of chapter 5.
5.3. The vehicle is considered properly returned once it is locked via the mobile app and the End Booking button is pressed.
5.4. Before the end of the reservation, the Lessee is obliged to inspect the vehicle and report any damages via the mobile application, where phone and e-mail contacts for support of the service are listed.
5.5. The Lessee acknowledges that he/she is fully responsible for any unreported damages to the vehicle and that he/she will be charged the appropriate amount according to the budget set by a forensic expert in the field of automotive.
5.6. In the event that the Lessee does not properly terminate the reservation of the vehicle or does not extend its duration in time, the Lessor is entitled to demand a contractual penalty of CZK 1,000 for each day the vehicle is unjustifiably blocked. A breach of this obligation is defined as a situation in which the renter acts in this way repeatedly or fails to remedy the situation even after a request from the lessor.
6. Complaints
Claims for invoiced amounts can be made by email to reklamace@drivesmart.cz. The lessee is obliged to support the claim with supporting documents that will be compared against the secure mileage database records that are automatically available for each vehicle for a period of 4 years.

II. Personal Data Protection (GDPR)
This privacy statement provides information to help you understand how we collect, use and share your information when you use the GoDrive service. We protect your privacy according to new EU Act 2016/679 from 27th April 2016 (GDPR).

Subject of data: user of GoDrive service
1. Processing personal data
C1 processes identification data (name, surname, date of birth, ID card/passport number, driving license number), contact data (permanent stay address, e-mail, phone number, Facebook account, Google account), data in CVs of job applicants, order history, invoices and claim information.
C2 processes data in scale and purpose described on its website www.csob.cz; generally it is credit/debit card number, name of trader, place of business, date and total transaction amount.
2. Personal data processing purpose
C1 processes data within these unambiguous purposes:

service providing incl. claims: identification and contact data, reservation length and date. Data are processed for the whole period of contractual relationship.

assertion of contractual claims after termination of the contract: identification and contact data, reservation length and date, pickup location. Data are collected for 4 years; if trial has started, collection continues the whole trial period.

e-mail newsletters: contact data according to Act 480/2004 Sb. Data are processed for indefinite period till the subject sign out the newsletter (sign out possible directly from the e-mail by button clicking.

obligation fulfillment in accountancy and taxes: data processing accourding to Accountancy and Tax Law. Data are processed for 5 years from the end of tax period related to GoDrive service use.

C3 processes data within this unambiguous purpose:

3. Personal data protection
C1 processes personal data with proper security protection including modern technical and organizational arrangements in order to protect from unauthorized or illegal processing, from accidental loss, damage or destruction. Subject data are stored in TIER III-certified data center in the Czech Republic, where only authorized C1 emploees may access it (access is logged).
C2 protects data with methods available at www.csob.cz.
4. Automated individual decision-making and profiling
C1 does not use automated individual decision-making or profiling when processing personal data.

5. Personal data handover to 3rd parties
C1 do not handover Subject personal data to third perties except public interest (execution, determination or legal right protection in trial or administrative procedure).

6. Subject rights
Subject may enforce all the individual rights defined by GDPR against C1 through e-mail: info@drivesmart.cz. It is necessary to send every single e-mail for every single individual right whereas the name of the right will be stated in e-mail subject. The e-mail body will then contain proper definition of right execution. If all these conditions are maintained, Subject is contacted back within 5 working days via phone, where C1 validates the e-mail was sent by authorized person. The right is executed according to Law deadline after successful authorization.
Subject may enforce all the individual rights defined by GDPR against C2 according to rules available at www.csob.cz (C2).
7. Data subject is entitled to request data deletion. This is only possible via GoDrive mobile app in the Registration details - Cancel account section. Data Controller and Processor is not obliged to delete personal data which he is required to keep according to section 2.
III. Conditions in a Nutshell
For those who are not lawyers but want to quickly learn what their rights, duties and responsibilities are. Let's do it!

The operator of the GoDrive service is DriveSmart, s.r.o.

Who can use the service? Anyone with an Android or iOS smartphone, a valid driver's license, ID card, an EU credit card (Visa/MasterCard) and an existing and working email with a contact phone. US-issued cards are not supported.

You can use the service for personal and business purposes. For companies - we are VAT payers.

Where does the service work? In České Budějovice. You can travel with the vehicles throughout the Czech Republic and the EU, but you must always return them to České Budějovice. You can find the current location of the cars in the GoDrive mobile app.

Registration? It takes place exclusively in the GoDrive CZ mobile app, where you need to upload your ID, driver's license and add a payment card.

Who can drive the car? Only and only the user who has made the reservation and therefore we know personal data about him/her, because of possible offences and the risk of strict liability in case of an administrative offence.

Credit card verification? When a card is added, 1 CZK is charged for verification, which is refunded immediately. The payment card details are stored securely at CSOB, we do not have access to them. The card must be enabled for online payments with a sufficient limit.

Booking a car? Once you have completed your registration, you can book your vehicle at any time. The app will display the available cars, their location and price. By pressing the "Book" button, the car is reserved and the rental contract is automatically concluded for the duration of the reservation.

Fuel is included! If you need to refuel, use the CCS card in the passenger compartment. You can find the PIN for it in the app under the "eyelet". If you fill up and pay out of pocket, send us your receipt and we will charge you back for the fuel.

Refundable deposit? A refundable deposit of CZK 3,000 is automatically charged to your credit card on your first journey. You cannot book a vehicle without a refundable deposit.

What is the deposit used for? The deposit covers any debts, such as unpaid rent, contractual penalties, damage to the vehicle and other financial obligations associated with the rental.

When and how do I get my deposit back? If everything is in order, the deposit is refunded three months after it has been paid. Simply send a request for refund. If the deposit has been partially used to pay debts, the remaining part will be refunded.

What happens if I reach the pre-paid rent? If the fare exceeds the pre-paid package or one-off deposit, the fare will be automatically refunded when the amount reaches at least CZK 300. This amount will be automatically charged to your credit card.

What if the required amount is not charged to the card? The user will be informed by e-mail or SMS. If there are insufficient funds on the payment card, the lessor is entitled to block further rides until the amount due is paid.

Opening the car? The car can be unlocked in the app 5 minutes before the start of the booking. Locking works the same way.

Return the car? You must return the vehicle to one of the shared zones marked in the app, lock it properly and press "End booking" in the app. Payment will be automatically charged to your credit card according to the price list available at www.godrive.cz. Reservations cannot be terminated outside the shared zone!

Car insurance? All cars are insured with statutory and breakdown insurance. If you cause an accident, you will be charged a deductible of 5% of the total damage, but a minimum of CZK 5,000. To this amount is added a flat-rate compensation for the costs of damage to the vehicle (hereinafter referred to as "flat-rate compensation") up to a maximum of CZK 10,000. In the case of total damage, the deductible is increased to CZK 25,000.

What is lump sum compensation? The lump sum compensation is a fixed amount of up to CZK 10,000 charged to the lessee in excess of the lessee's deductible and is intended to cover the costs associated with the administrative and operational handling of the claim.

Driving under the influence of alcohol or drugs! If you damage the car when you are not fit to drive, the excess increases to 100%.

Loss of keys? You are responsible for the destruction, loss or theft of your vehicle keys. If you lose or damage your car key, you may be charged a minimum penalty of CZK 10,000. If the actual damage is higher, the landlord is entitled to claim compensation up to this actual amount.

Cleanliness of the vehicle? If the interior is dirty, you are responsible for cleaning. You are obliged to keep the vehicle clean, tidy and hygienic. If you do not return the vehicle to us in a clean condition, we are entitled to a contractual penalty of CZK 2,000. You do not have to wash the exterior if the car is still in working order.

No entry to places without a signal! It is forbidden to drive your vehicle into places where there is no signal from mobile operators (atomic shelter, underground garages, etc.).
